Please read these Terms and Conditions (“Terms”) carefully before accessing or using the website https://mycs.swiss(the “Site”), any associated services, training courses, audits, consulting, manuals, or other offerings provided by Continuous Safety (MYCS) (“we,” “us,” “our,” or “MYCS”).

By accessing the Site, booking services, enrolling in training, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, you must not use the Site or our services.

1. About Us

Continuous Safety (MYCS) provides aviation safety and compliance services, including Safety Management System (SMS) implementation, compliance audits (e.g., IS-BAO, EASA, ICAO), tailored training (classroom, hybrid, e-Learning), manual preparation (OMM, CAME, MOE, etc.), and related consulting for AOCs, CAMOs, AMOs, aerodromes, and other aviation organizations.

2. Acceptance of Terms and Eligibility

These Terms form a legally binding agreement between you (the individual or entity using the Site or services, “you” or “Client”) and MYCS. You represent that:

  • You are at least 18 years old or the legal age of majority in your jurisdiction.
  • If acting on behalf of a company or organization, you have full authority to bind that entity.
  • You will use our services only for lawful business purposes in the aviation sector.

3. Services and Bookings

  • Descriptions: We strive for accuracy in service descriptions, courses, pricing, and availability on the Site. However, we reserve the right to correct errors or make changes without notice.
  • Bookings and Contracts: Bookings for audits, training, consulting, or manuals are confirmed only upon our written acceptance (e.g., email confirmation or signed agreement). Quotes are non-binding until accepted.
  • Custom Services: For tailored solutions (e.g., SMS implementation, manual preparation), specific terms may be outlined in a separate Service Agreement that supplements these Terms.
  • Intellectual Property in Deliverables: Training materials, manuals, audit reports, and other deliverables are licensed for your internal use only. You may not reproduce, distribute, or resell them without our prior written consent.

4. Payments and Fees

  • Prices are in the currency specified (typically CHF, EUR, or USD) and exclude applicable taxes/VAT unless stated.
  • Payment terms: Full or partial payment as per the invoice or agreement (e.g., upfront for training, milestone-based for projects).
  • Late payments may incur interest at the maximum legal rate and may result in suspension of services.
  • We accept major payment methods; specific options will be communicated during booking.
  • Refunds: Generally non-refundable except as required by law or explicitly stated in a specific service agreement. Training cancellations may be subject to fees (e.g., full refund if cancelled 14+ days prior, subject to policy).

5. User Responsibilities and Conduct

You agree to:

  • Provide accurate, complete information for bookings, registrations, and service delivery.
  • Comply with all applicable aviation regulations (ICAO, EASA, FAA, etc. as applicable) and not use our services to circumvent legal or safety requirements.
  • Maintain confidentiality of any access credentials or proprietary materials provided.
  • Not misuse the Site (e.g., no hacking, scraping, or interfering with operations).

We may refuse or terminate services if you breach these Terms or engage in conduct that could harm our reputation or operations.

6. Intellectual Property

  • The Site, its content, logos, materials, and methodologies are owned by or licensed to MYCS and protected by copyright, trademark, and other laws.
  • Limited license: You may view and use the Site for personal/business evaluation and engage our services as intended. No other rights are granted.
  • You grant us a non-exclusive license to use any materials you provide (e.g., for audits or customization) solely to deliver the services.

7. Privacy and Data Protection

8. Disclaimers and Warranties

  • Services are provided “as is” and “as available.” We do not guarantee specific outcomes (e.g., regulatory approval or accident prevention), as these depend on your organization’s implementation and ongoing compliance.
  • We warrant that services will be performed with reasonable skill and care consistent with industry standards. All other warranties (express or implied) are disclaimed to the maximum extent permitted by law.
  • Aviation compliance is complex and subject to evolving regulations. Our advice is not a substitute for legal or regulatory counsel.

9. Limitation of Liability

To the fullest extent permitted by law:

  • MYCS’s total liability for any claim arising from these Terms or our services shall not exceed the fees paid by you in the 12 months preceding the claim.
  • We are not liable for indirect, consequential, incidental, punitive, or special damages (e.g., loss of profits, data, or business opportunities), even if advised of their possibility.
  • Nothing in these Terms excludes liability for death, personal injury due to negligence, or fraud where prohibited by law.

10. Termination

  • We may terminate or suspend access to services/Site for breach of these Terms, non-payment, or other good cause, with or without notice where appropriate.
  • You may cancel services as per the specific agreement or applicable cancellation policy. Outstanding fees remain payable.

11. Changes to Terms

We may update these Terms periodically. Continued use of the Site or services after changes constitutes acceptance of the updated Terms. We will post the new “Last Updated” date.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Switzerland, Kanton GR, without regard to conflict of laws principles. Disputes shall be subject to the exclusive jurisdiction of the courts in the canton of the MYCS registered office (or as otherwise agreed).

13. Miscellaneous

  • Severability: If any provision is invalid, the remainder remains in effect.
  • No Waiver: Failure to enforce a right does not waive it.
  • Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., strikes, natural disasters, regulatory changes).
  • Entire Agreement: These Terms (plus any Service Agreement) constitute the full understanding between you and us.
